These Terms & Conditions (“Terms”) govern your access to and use of GoContinuity.com (the “Website”) and any related communications, materials, scheduling tools, forms, or services provided by Continuity (“Continuity,” “we,” “us,” or “our”). Please read these Terms carefully.

By accessing or using the Website, submitting information, scheduling a call, downloading materials, requesting an assessment, or engaging with Continuity’s services, you agree to be bound by these Terms. If you do not agree, do not use the Website or services.

2. About Continuity

Continuity provides operational transition execution and administrative coordination support for financial advisors and advisor teams planning, coordinating, tracking, and completing advisor book transitions when moving firms, platforms, custodians, broker-dealers, RIAs, or going independent.

Continuity may provide transition-readiness assessments, operational workflow support, household/account data organization, document tracking, transfer status tracking, exception tracking, and completion-phase coordination.

Website content is provided for informational purposes only and does not create any advisory, fiduciary, legal, tax, compliance, brokerage, custodial, or investment relationship.

3. No Investment, Legal, Tax, or Compliance Advice

Continuity does not provide investment advice, legal advice, tax advice, compliance advice, securities recommendations, financial planning, or custody/brokerage services. Continuity is not a broker-dealer, custodian, law firm, tax advisor, compliance firm, or investment adviser.

4. No Custodian, Broker-Dealer, or RIA Affiliation

Continuity is independent and is not affiliated with, endorsed by, or acting on behalf of any custodian, broker-dealer, RIA platform, or financial institution unless expressly stated in a written agreement.

Any references to custodians, platforms, broker-dealers, RIAs, software systems, or financial institutions are for descriptive purposes only. If any trademarks are referenced, they belong to their respective owners.

5. Website Content and Educational Materials

Blog posts, guides, videos, checklists, FAQs, readiness materials, downloads, and other content are provided for general informational purposes only. Content may not reflect your specific circumstances and should not be relied upon as professional advice.

6. Services and Engagements

Any paid or formal engagement with Continuity will be governed by a separate written agreement, statement of work, order form, or engagement letter. If there is a conflict between these Terms and a signed agreement, the signed agreement controls for that engagement.

7. User Responsibilities

You are responsible for:

  • Providing accurate, complete, and current information
  • Ensuring you have authority to share any information with Continuity
  • Complying with applicable laws, regulations, firm policies, employment agreements, confidentiality obligations, non-solicitation obligations, privacy rules, and transition-related restrictions
  • Obtaining legal, tax, compliance, and regulatory advice where needed
  • Reviewing all documents, forms, submissions, and transition materials before use or submission
  • Making final decisions about client communications, custodian instructions, account transfers, and transition actions

8. Client Data and Authorization

Advisors, firms, or authorized parties may provide information related to clients, households, accounts, paperwork status, transfer status, and operational workflows.

You represent and warrant that you have the right and authorization to provide such information to Continuity and that the information is provided through approved and lawful channels. Continuity may rely on your authorization and representations.

9. No Guarantee of Asset Movement, Client Retention, Timing, or Outcomes

Continuity does not guarantee:

  • That any client will transfer
  • That any account will be accepted
  • That any asset will be transferable
  • That any custodian, broker-dealer, platform, or firm will approve a transfer
  • That any transition will be completed within a specific timeframe
  • That any specific percentage of assets will move
  • That any paperwork will be accepted on first submission
  • That any regulatory, legal, tax, or compliance issue will be resolved

Many transition outcomes depend on third parties, client decisions, account type, asset type, custodian rules, firm policies, paperwork accuracy, market activity, and regulatory/compliance constraints.

10. Operational Support Limitation

Continuity may help organize, coordinate, track, and support operational workflows, but does not control custodians, broker-dealers, delivering firms, receiving firms, clients, regulators, clearing firms, transfer agents, or other third parties. Decisions, approvals, processing, and timelines may be determined by those parties.

11. Third-Party Platforms, Custodians, and Tools

Services may involve or reference third-party platforms, custodians, CRMs, e-signature systems, document repositories, transfer systems, workflow tools, or other technology. Continuity is not responsible for the availability, security, accuracy, policies, decisions, delays, errors, or performance of third-party systems or providers.

12. Confidentiality

Continuity takes confidentiality seriously and expects users to do the same. Information shared in connection with services should be handled in accordance with applicable agreements, policies, laws, and the Privacy Policy. Confidentiality obligations for specific engagements may be further defined in a separate written agreement.

14. Security

Continuity uses reasonable administrative, technical, and organizational safeguards designed to protect information. However, no method of transmission, storage, or electronic communication is completely secure, and we cannot guarantee absolute security.

15. Prohibited Uses

You may not:

  • Use the Website or services for unlawful purposes
  • Upload malicious code or attempt unauthorized access
  • Provide information you are not authorized to share
  • Misuse confidential client, firm, or account data
  • Misrepresent your identity, authority, affiliation, or licensing status
  • Copy, scrape, resell, or misuse Continuity materials
  • Interfere with Website or service operations
  • Use Continuity materials to violate firm policies, privacy obligations, employment agreements, non-solicitation restrictions, or applicable law

16. Intellectual Property

The Website, brand, logo, copy, frameworks, checklists, graphics, videos, guides, templates, readiness materials, dashboards, processes, and other materials are owned by Continuity or its licensors and are protected by applicable intellectual property laws.

You may not copy, modify, distribute, sell, or create derivative works from these materials without Continuity’s prior written permission.

17. Downloadable Materials and Templates

Any checklists, templates, readiness assessments, guides, or tools are provided for informational and operational planning purposes only. They must be adapted to your specific circumstances and reviewed by appropriate legal, compliance, tax, or firm professionals before use.

18. Testimonials, Case Studies, and Examples

Any testimonials, case studies, examples, hypothetical scenarios, or illustrative numbers are provided for informational purposes only and do not guarantee similar outcomes.

19. Fees and Payment

Fees, payment terms, deposits, retainers, billing cadence, cancellation terms, and refund policies (if any) will be stated in the applicable written agreement, order form, or invoice. Website content does not create an obligation for Continuity to provide services at any particular price.

20. Scheduling Calls and Submitting Forms

Submitting a form, requesting an assessment, or scheduling a call does not create a client relationship, service agreement, confidentiality agreement, or obligation for Continuity to accept an engagement unless confirmed in writing.

21. Right to Refuse or Terminate Services

Continuity may decline, suspend, or terminate Website access or services if:

  • You provide unauthorized data
  • The engagement creates legal, compliance, privacy, security, or conflict concerns
  • You fail to pay agreed fees (if applicable)
